O Supremo Tribunal Federal e o ativismo judicial: (re)analisando o dogma do "legislador negativo"

Abstract

This text has the purpose of analyzing the actual role of the Judicial Power in Brazil. The objective is to analyze the increasing of the actuation of the Judicial Power, specially the Supreme Court, in the context of what is called judiciary activism. In our text we will study concrete cases and their implications in the political structure of Brazil, thinking over how judiciary activism is legit.
