Abstract

The scope of this paper is to discuss the effectiveness of a substantive law based on a hermeneutic relationship between constitutional, law principles, theory of relativity and quantum mechanics. For this, it will examine systematically the ruling as a relative truth and probabilistic determined by reference employed by the magistrate in the analysis of the case. In this context, the search for Providence or court shall be conducted not according to legal activity that, based on exegesis and the principles of law, find a particular solution among several possible may come to the judge so that he can carry the right standardized and guaranteed by the Constitution of the Republic of Brazil, without necessarily exclude one another principle when prioritizing the moment of impact principles.
